Vehicle Misuse & Mechanical Damage Liability

The Renter assumes full financial responsibility for any mechanical, engine, transmission, or drivetrain damage resulting from driver error, reckless operation, or misuse during the rental period. This includes, but is not limited to, damage caused by driver-induced mechanical overrevving (commonly referred to as a "money shift"), improper clutch operation (dumping the clutch), intentionally drifting and continued operation after excessive temperature/low fluid levels or displayed warning lights. Liability includes the total cost of parts, labor, and diagnostic fees.

Comprehensive Liability Waiver & Express Assumption of Risk

Motorsports, high-performance driving events (HPDE), track days, and circuit driving are inherently dangerous activities. Operating a vehicle on a racetrack involves severe, uncontrollable risks that can result in significant property damage, serious bodily injury, permanent disability, or death.

By entering onto the track, you voluntarily and knowingly assume all risks associated with track operations, including but not limited to:

  • Vehicle Performance & Mechanical Failure: Tire blowouts, brake fade or failure, fluid leaks, structural failures, or loss of control at high speeds.

  • Track & Environmental Hazards: Debris, oil spills, surface irregularities, standing water, guardrails, tire walls, concrete barriers, and extreme weather conditions.

  • Actions of Third Parties: Negligence, erratic driving, loss of control, or mechanical failure of other drivers or vehicles sharing the track surface.

  • Emergency Response Delays: Risks associated with delayed medical treatment, evacuation, or fire suppression on circuit grounds.

Standard rental contracts ask drivers to promise they won't be negligent. A track rental contract must do the opposite: it must state that the driver knowingly enters a high-hazard environment where severe injury, death, or total financial loss is possible.

  • Release of Liability & Indemnification: The driver agrees to hold your company, employees, and agents harmless from claims arising from mechanical failure, accidents, or injury.

  • Third-Party Damage Waiver: Explicitly state that if the renter collides with another driver on track, your rental company bears no liability for the other driver's damage or medical bills.
